Facts:

Following the running of the DUNSTAN HORSE FEEDS MOBILE PACE 2200m, an Information was lodged by Senior Stipendiary Steward, Mr JM Muirhead against Licensed Amateur Horsewoman, Ms Sheryl Wigg alleging that Ms Wigg when driving MT POCKETS used her whip on more occasions than permitted under Clause (b) of the Use of Whip Regulations.

Rule 869(2) provides: No horseman shall during any race use a whip in a manner in contravention of the Use of Whip Regulations made by the Board.

Clause (b) of the Use of Whip Regulations provides : No horseman is permitted to use their whip in a striking motion on more than 10 occasions inside the final 400 metres. This is inclusive of " backhanders" and the use applies to the horse , harness and/or sulky.

Ms Wigg acknowledged on the Information that she admitted the breach and she advised the Committee that she did not wish to be present at the Hearing.

Mr Muirhead demonstrated the incident by use of the race films and showed where inside the 400 metres mark Ms Wigg used her whip at least 14 times.

Submissions for Penalty:

Mr Muirhead submitted that because of the number of strikes the penalty should be a fine in the amount specified in the second tier of the Whip Regulations.

The breach is admitted and the number of strikes means that the penalty to be applied is a fine of $300 as set out in the Use of Whip Regulations and as set out in the JCA Guidelines.
