Facts:
Following the running of Race 4, the Signbiz Mobile Trot, an information raising a protest was lodged by Stipendiary Steward Mr S P Renault against Mr G O’Reilly, alleging a breach of Rule 870(2)(c) in that November Guy “failed to lose ground when in a break” over the concluding stages.
Rule 870 reads:
“(1) When any horse breaks from its gait in any race its horseman shall immediately take all reasonable steps to return it to its proper gait and where clearance exists immediately take such horse clear of the field …
(2) The following shall be a breach of sub-rule (1) hereof: …
(c) Failure to lose ground by the break.”
Mr O’Reilly did not contest the protest and was not present at the hearing.
Submissions for Decision:
Through video evidence Mr Renault showed November Guy galloping in a break during the last 50 or so metres of the race during which it made ground on the horses around it. In particular, Family Night who was disadvantaged by the galloping November Guy. That horse when galloping improved its position and had it lost ground as required by the rules would have finished in a lapped on position to Family Night.
Mr Renault sought the disqualification of November Guy pursuant to Rule 1003(2)(a) which entitles this committee to disqualify a horse which has breached a rule.
Reasons for Decision:
After hearing the submissions the Committee has determined to disqualify November Guy on the basis that it clearly on the video evidence failed to lose ground when in a break during the closing stages of the race.
