As the breach of the Rule was admitted the charge is found proved.

Penalty:

Mr Kasim is suspended from the close of racing on Wednesday 2 May 2012 to the close of racing on Tuesday 8 May 2012, that is four riding days being Hawkes Bay (4 May), Te Rapa (5 May), Counties (7 May) and Waverley (8 May).

Charge:

Following the running of Race 4 Information A3473 was filed by Stipendiary Steward Mr N Goodwin stating "in that passing the 1000m H Kasim has permitted his mount PINOCCHIO BOY to shift in when not clear which has resulted in ALPENA ROSEA being checked".
 
Rule 638(1d) states:- "A rider shall not ride a horse in a manner which the Judicial Committee considers to be ......careless" 
 
Mr Kasim confirmed that he understood the Rule he was charged under and also that he admitted the breach of the Rule.

Facts:

Mr Goodwin used the head-on and side-on films to describe the incident.  He said Mr Kasim, who was drawn 1 from the outside in the 14 horse field commenced moving across soon after the start of the 1400m race.  At approximately the 1000m point as he continued his move across he was not sufficiently clear of "Fraggle Rock" (J Waddell) who was dictated inwards and hampered "Alpena Rosea" (M Cameron) who had to check off heels losing approximately one and a half lengths in the jostling that happened.  Mr Goodwin said that "The Aftershock" (K Myers) who was down on the rail was also affected in the incident.
 
Mr Kasim said he had moved across from his wide draw and he agreed that he came in sharply and had put pressure on Mr Waddell's horse although he thought both Mr Cameron and Ms Myers' mounts had overreacted when the tightening occurred.  He said he did not look when he was initially coming across and when he did take a look the interference had already occurred.
Mr Johnson had no comments to make on Mr Kasim's behalf.

Submissions for Penalty:

Mr Goodwin said this was the second breach of the careless riding rule by Mr Kasim in the past 12 months with the previous breach being on 12 February 2012.  He said Mr Kasim had a very good riding record and the Stewards considered the severity of the incident to be in the "low to mid" range and submitted that a 4 day period of suspension was an appropriate penalty.
 
Mr Kasim said he had no confirmed riding engagements after Wednesday 2 May and after talking to his manager he did not wish to seek a deferment of any suspension.  He also confirmed he only rode in the North Island.
 
Mr Johnson had no comments to make on behalf of Mr Kasim.

Reasons for Penalty:

The Committee has considerd the evidence of the films and considered the submissions of both parties.  The head-on film is particularly helpful and shows Mr Kasim moving across from his wide draw and not being the required distance clear when coming across Mr Waddell which led to the consequential hampering of Mr Cameron and also Ms Myers.  Mr Kasim by his own admission said he came across sharply and put pressure on Mr Waddell's mount which in turn caused Mr Cameron to have to check off heels.  The Committee views the severity in the mid range but also takes into account Mr Kasim's admittance of the breach and his very good riding record.  The Committee believes a period of suspension is an appropriate penalty and from a starting point of 5 days is prepared to reduce that by one day for the mitigating factors detailed.
