As Mr Rusof admitted the breach the Committee found the charge proved.
Penalty:
The Committee grants a deferment to Mr Rusof’s suspension pursuant to Rule 1106(2).
Accordingly, Mr Rusof had his license to ride in races suspended for a period to commence after racing on 12 May and conclude after racing on 24 May 2018.
The race meeting at Invercargill on 13 May was not included in Mr Rusof’s penalty because the declaration of riders had closed.
Facts:
Following the running of race 6, Waipa Home of Champions 1400, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Jones, alleged that Mr Rusof permitted his mount SEIRIOS to shift inwards shortly after the start when not sufficiently clear crowding COSSACK WARRIOR onto SIENNA GRACE.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Rusof acknowledged that he understood the Rule and confirmed that he admitted the breach.
Mr Balcombe demonstrated the incident using the available video footage. He identified that shortly after the start Mr Rusof angled his mount in when not sufficiently clear. He said Mr Rusof continued to allow his mount to shift in which resulted in tightening to COSSACK WARRIOR and SIENNA GRACE. He added that Mr Rusof did not relieve the inward pressure.
Mr Rusof admitted that he shifted in when not sufficiently clear but felt that COSSACK WARRIOR shifted out “a little bit”.
Submissions for Penalty:
Mr Jones produced Mr Rusof’s record which showed 2 previous breaches under this Rule this season. He said that Mr Rusof allowed SEIRIOS to shift in when not clear and he made no attempt to straighten his mount. He said the carelessness was towards the lower end of the scale.
Mr Rusof was unaware of his upcoming engagements so the Committee granted an adjournment so Mr Rusof could contact his Agent.
After speaking to his Agent Mr Rusof advised that he had firm engagements on 12 May at Rotorua and sought a deferment to fulfil those engagements. He had nothing further to add.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented.
It was clear from the video films that Mr Rusof permitted his mount to shift in shortly after the start when not the required distance clear. This resulted in 2 runners to his inside being crowded for racing room. The head on film showed that Mr Rusof angled his mount in on too sharp an angle and he failed to take any corrective action. The Committee deemed the level of carelessness to be in the low to mid-range and adopted 7 national riding days as the starting point.
The NZTR website shows that to date for 2017/2018 racing season Mr Rusof has had 44 rides. The Committee deemed Mr Rusof’s record as poor and an aggravating factor with today being Mr Rusof’s 3rd breach of careless riding from such a small amount of rides. In view of that, a 1 day uplift in penalty was applied.
The only mitigating factor was Mr Rusof’s admission of the breach for which a 1 day reduction was applied.
After taking into account all the above factors the Committee considered that an appropriate suspension was 7 national riding days.
