Decision:

We are satisfied that Ms Williams has moved in slightly when not her length and another clear of Ms Direen. This movement however is marginal in nature, and is not sufficient to constitute careless riding. The charge is dismissed.

Facts:

Following the running of race 6 the Fire and Mechanical Premier Sprint Mr Davidson alleged that Ms Williams allowed her mount BOWLING BOY to shift in dictating VALIANT in on to OUR GENES and CREDIT CRUNCH which were both checked passing the 1100 metres.

Rule 638 (1)(d) provides: A rider shall not ride a horse in a manner, which the Judicial Committee considers to be careless.

Submissions for Decision:

Mr Davidson asked Mr McIntyre Co-chief stipendiary steward to demonstrate the alleged breach on the videos. He demonstrated that Mrs Pitman, CREDIT CRUNCH, was racing on the fence, outside of her was Ms Morgan, OUR GENES, and to her outside was Ms Direen, VALIANT. Ms Williams, BOWLING BOY, was to the outside of Ms Direen. He said Ms Williams was not clear when she moved inwards with the result that there was crowding to the three runners on her inside and that VALIANT, in particular, was screwed inwards on to OUR GENES. He said it was a simple equation: four horses into two did not go.

First to give evidence was Mrs Pitman. She said that after 100 metres she was on the fence looking for a forward position. She had received pressure from her outside and was checked. She yelled to Ms Direen to give her room and Ms Morgan was yelling as well. She said Ms Direen’s mount was rubbing shoulders with that of Ms Morgan. She thought at the time it was pressure from Ms Direen and after viewing the videos still thought Ms Direen played a big part in the incident. She was struggling to see from the videos where Ms Williams had put pressure on Ms Direen. She believed Ms Direen was always on top of Ms Morgan who could not relieve the pressure on her (Mrs Pitman). She added Ms Direen was heading inwards before Ms Williams put any pressure on her. The fact that Ms Direen’s horse was angled inwards demonstrated this. In response to questioning by the Committee, she said Ms Williams, in her view, was not heading inwards as severely as was Ms Direen.

Ms Morgan stated that she was hunting up OUR GENES when she was checked “quite badly” by the horse racing on her outside. She had not concentrated on who was outside the horse that was outside her. She said VALIANT was laying in all over OUR GENES. She said she and Mrs Pitman were both yelling that it was tight. On looking at the videos she could not see how there had been pressure from Ms Williams as Ms Direen was already coming across before it got tight. She said the contact by her horse with VALIANT had caused that horse to screw sideways.

Ms Direen stated that she had gone for a forward position. Her horse was racing keenly and it had become tight. She thought the pressure was from her outside and she called for relief. She was also aware that her mount, VALIANT, which was not that experienced, was field shy. She said she had made contact with OUR GENES. She had never come into contact with BOWLING BOY. She said she was slightly under pressure but it was half the fault of her horse. She heard calling from her inside to relieve the pressure. In response to a question from Mr Davidson, she said the respondent had shifted in, but only slightly. She said she could have relieved the pressure by moving outwards, but she was in an awkward position. She said she thought her horse had screwed because of the contact but also the horse had seen the gap and was going for it. She said there was only slight movement from the outside and the inside horse might have moved out as well. In response to questioning from Ms Williams, she said she (Ms Williams) had called to her before this incident but not again. In response to questioning by the Committee, she said the movement from Ms Williams was not enough to have caused her horse to screw and she was primarily blaming her own horse.

Ms Williams said her horse might have moved in slightly but Ms Direen was always moving inwards and this was while she was continuing to push VALIANT forward. She said her movement in contrast to that of Ms Direen was only fractional. Ms Direen was already angling her mount inwards before she (Ms Williams) moved. She said the videos clearly showed she had not caused Ms Direen to go in and put pressure on the two horses to her inside. Ms Williams said she had heard calling from Ms Direen prior to the incident and had taken action by straightening her mount but she had not heard calling at the time of the incident.

Mr Davidson summed up by stating that the stipendiary stewards believed Ms Williams had shifted in marginally and there was consequently nowhere for Ms Direen to go when she was trying to relieve the pressure on her and the horse to her inside. Ms Williams was only ¾ of a length clear when she shifted inwards and VALIANT was dictated inwards. He acknowledged Ms Williams did relieve the pressure but this was after the incident had occurred.

Reasons for Decision:

Ms Williams has pushed her mount out looking for a forward position. In so doing she has shifted inwards towards the rail from a four wide position. Prior to the incident, and on hearing calling, she has immediately removed any pressure on VALIANT. She has shortly thereafter continued to push forward but any inwards movement from this time is marginal. There is no contact between BOWLING BOY and VALIANT and there is clear gap between these two horses when VALIANT screws. The reason for this horse screwing sideways, we believe, is contact between the shoulders of VALIANT and OUR GENES. None of the three witnesses have put the blame for the tightening on Ms Williams. Ms Direen, herself, has said her horse was primarily to blame, noting that it had not raced in the body of the field with other horses before. Mrs Pitman and Ms Morgan both blame Ms Direen for placing pressure on them by shifting in when she too was pushing forward looking for a handy position. They do not believe that Ms Williams has placed pressure on Ms Direen.
