Facts:
Information Number A2707 read that horse No.4 WHEELER FORTUNE placed first by the Judge interfered with the chances of horse No.10 TRUE SECRET placed second by the Judge.

Rule 642(1) reads:
If a placed horse or its rider causes interference within the meaning of this Rule 642 to another placed horse and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred they may place such first mentioned horse immediately after the horse interfered with.

Miss R Myers the rider of TRUE SECRET said that shortly after entering the straight WHEELER FORTUNE commenced to shift out and forced her horse out over several horse widths. She said that she tried to straighten her horse but that J Parkes’ horse continued to roll out. She said that if both horses had gone straight and that her horse had not been intimidated by WHEELER FORTUNE and Jonathon Parkes’ stick that she would have won the race.
Mrs J Millar, the trainer of TRUE SECRET said that you could see that her horse’s head was turned inwards and that it was forced outwards and that it was not just running out. She added that at one stage it looked like her horse was going to go past WHEELER FORTUNE.
Mr Parkes, the rider of WHEELER FORTUNE said that he had not made contact with the second horse and that horse had actually come up level with his horse and that while his horse shifted out the second horse also shifted out. He added that TRUE SECRET had had its chance in that it came up level, but over the final stages his horse was going stronger. He reiterated that although his horse had run out a bit, contact had not been made.
Mr Wheeler, trainer of WHEELER FORTUNE said that the second horse had headed the subsequent winner and that it was running out the whole way and that his horse was just following it out. He said that there had not been any contact and that it (the protest) was almost frivolous. He added that when both horses first shifted that there were three horse widths between them and that TRUE SECRET shifted first.
Reasons for Decision:
The committee found that after entering the final straight both WHEELER FORTUNE and TRUE SECRET shifted outwards away from their original position from the running rail by several horse widths. After careful consideration of all the evidence and in particular that of the head-on video replay, the committee was satisfied that the two horses shifted of their own accord and that WHEELER FORTUNE did not interfere with TRUE SECRET.
