The Protest is upheld and MIGHT BE ME is disqualified from fourth placing under r 1003 (2).

Facts:

Mr Munro lodged a Protest against the fourth placed MIGHT BE ME under r 870 (3) alleging that the horse galloped in excess of 50 metres inside the final 200 metres.  Mr Beck appeared for the connections of the horse.

Submissions for Decision:

Mr Munro, with the aid of the videos, said MIGHT BE ME challenged for the lead and made the lead about 100m from the finish. However, soon after MIGHT BE ME broke from its gait and failed to recover before the finish line. He outlined on the video where the horse initially broke and estimated the distance to be approximately 60 metres, as determined by the marker pegs. Under the rule he sought disqualification of MIGHT BE ME from fourth placing.

Mr Beck stated the horse may have shied at the trackside camera person, situated on the outside of the track and opposite the finish line. He said his horse spotted the camera person and shied away causing it to get off balance and break.

Reasons for Decision:

The provisions of the Breaking Horse Regulations state a committee has a discretion to not disqualify a horse under the r 870 (3) if the breaking horse (MIGHT BE ME) had suffered interference from another runner or a horseman. However, MIGHT BE ME broke from its gait at least 60 metres away from the camera person and we do not see that as a factor in this instance.
