As the charge was admitted it was deemed to be proved by the Committee.

Penalty:

As Ms Fawcett’s Apprentice Jockey’s Licence was suspended up to the end of racing on 19 January 2018 for earlier breaches of the Rule, her Licence to Ride in races was further suspended up to and including racing on 27 January 2018.

Facts:

Following the running of race 2, (Mainstream Plumbing & Gasfitting 1400), Information No.A10029 was filed with the Judicial Committee. It was alleged that Ms Fawcett the rider of POLZEATH allowed her mount to shift out near the 250m when not sufficiently clear of MAKTOUM which was dictated out into the line of REBEL KNIGHT which was checked.

Rule 638(1)(d) provides:
A rider shall not ride a horse in a manner which the Judicial Committee considers to be careless

Ms Fawcett acknowledged that she understood the Rule, Charge and confirmed to the Committee that she admitted the breach.

Mr Coles identified all 3 horses involved on the film replays and said that near the 250m Ms Fawcett shifted her mount out when only a bare length clear. He said that this resulted in MAKTOUM being taken out into REBEL KNIGHT’S line which was checked.

Ms Fawcett for her part said that her horse was travelling well and that the gaps closed and that when she went out she thought that she had room but that the films showed otherwise.

Ms Guy reiterated that Ms Fawcett’s horse was travelling well.

Submissions for Penalty:

Mr Oatham produced Ms Fawcett’s record which showed that on 29 December 2017 a 7-day suspension was imposed and that on 31 December 2017 a 6-day suspension was imposed. He said that it was of obvious concern that this was Ms Fawcett’s third careless riding charge in less than a week. He said that she is trying too hard and needs to be more patient. He submitted that a suspension in line with mid-range carelessness would be appropriate.

Ms Guy said that the horse (POLZEATH) was held up at its last start and that some people had been critical of Ms Fawcett’s ride on that occasion.

Reasons for Penalty:

The Committee was concerned that Ms Fawcett had breached the Careless Riding Rule three times since 29 December 2017. Taking into account the degree of carelessness (mid-range) the admittance of the breach and the JCA starting point of 8 riding-days suspension for mid-range carelessness, the Committee determined that a suspension of 7 riding days was an appropriate penalty.
