Ms Wynne is suspended from riding from the end of racing on Saturday 24 October up to and including Saturday 31 October. This is 4 Central District/ South Island days. Ms Wynne is reminded of her professional obligations and, in particular, with respect to the careless riding rule.

Mr Davidson alleged that in race 2 the VITAPOWER & PALAMOUNTAINS ANIMAL NUTRITION R85 1200m, Ms Wynne permitted her mount PINSGOLD to shift inwards passing the 1100 metres when not clear of THEM OR US (C Johnson), which had to be checked. THE LONE RANGER (B Murray) was checked as a consequence.
Mr Davidson demonstrated on the videos that shortly after the start Ms Wynne shifted from a four out position on an angled run towards the rail. Mr Johnson, who was racing on the rail and whose mount was racing keenly, had to take hold. The videos evidenced the fact that the respondent was only her length clear of Mr Johnson when she crossed.
Ms Wynne stated she had made a momentary error of judgment. She had not intended originally to go to the lead but her horse had jumped so quickly, this became a possibility. She said she had looked across and was aware Mr Johnson was there. However, his horse was over-racing and she realised now that she had not given him sufficient room. She said he had not called out to her.
Mr Harnett emphasised that Mr Murray’s mount was racing ungenerously after the start and that Ms Wynne’s actions had had a minimal effect on his horse. Mr Davidson did not dispute this.

Mr Davidson described the breach as mid range. While Mr Johnson had had to take hold of his horse, he had stated, when questioned by the Stewards, that he was happy to take a sit in behind Ms Wynne.
Mr Davidson stated that Ms Wynne was a South Island jockey who rode regularly in the Central Districts. He believed these meeting should be taken into account in determining penalty. He produced the respondent’s record, which showed 2 breaches in the past 10 months and 4 in the past 12.
Ms Wynne said she had ridden at Woodville last week and was keen to be able to ride at the Banks Peninsula meeting.

We believe the breach is correctly described as being at the lower end of mid-range. Mr Johnson has had to check his mount, which then had to be steadied for some distance. The trailing horse, THE LONE RANGER, also had to be checked at that point of the race, although, as previously noted, that horse had been racing ungenerously prior to this time. Ms Wynne was only her bare length clear when she crossed over to the rail.
Ms Wynne’s record has 2 breaches since May last. On both occasions she received a 3 day suspension. She was also fined $400 on the latter occasion. We regard Ms Wynne’s record as a neutral factor, considering the fact she is a sought after apprentice who rides regularly.
Having regard to the Penalty Guide, we believe a 5 day starting point is appropriate, as Ms Wynne cannot be classified as a "South Island rider' given the frequency with which she rides north of the Cook Strait. We give a 1 day discount for her admission of the breach and, in particular, the frank manner in which she has acknowledged her wrong-doing.
