It was ordered that PENNY KATE be disqualified from 6th place with placings adjusted accordingly.

Facts:

Prior to the running of Race 2, the CMP Canterbury Maiden 2100, an Information instigating a Request for a Ruling was filed by Stipendiary Steward Mr M Zarb, seeking disqualification of 6th placed horse PENNY KATE, after its rider, Miss Wynne, failed to weigh in as required by the Rules.

Rule 647(1) reads;

All Riders in a Race shall weigh-in, unless excused from doing so by a Stipendiary Steward. A horse whose Rider does not weigh in shall, in addition to any other penalty which may be imposed, be disqualified from the Race, unless the Stipendiary Stewards are satisfied that the:

(a) Rider’s failure to weigh-in, in accordance with this Rule, was justified by extraordinary circumstances, including if the Stipendiary Stewards are satisfied that, on account of accident or sudden illness, it is impracticable for him to weigh in; and

(b) Rider weighed out correctly with, and carried, his proper weight.

Submissions for Decision:

Mr Zarb gave evidence that Miss Wynne who was the rider of PENNY KATE which finished in 6th place, had failed to weigh in on her return to the birdcage. The Stewards, he said were seeking disqualification of PENNY KATE as per the Rule. Mr G Rowlands, Clerk of the Scales, also gave evidence that Miss Wynne did not weigh in after Race 2 as required.

Miss Wynne stated that she had been distracted by a trainer talking to her when returning to the weighing room and had simply forgotten to weigh in.

Reasons for Decision:

The Committee carefully considered all evidence and submissions presented. We were satisfied that the rider for PENNY KATE had failed to weigh in after finishing in 6th place. We were also satisfied that under the Rule, PENNY KATE was required to be disqualified from the race.
