Facts:

Following the running of Race 8, the Temuka Transport Handicap Trot, an Information Instigating a Protest was filed by Stipendiary Steward N McIntyre alleging interference by “Seppl” (3), driven by Mr J Anderson, to “Ruby N Diamonds” (1), driven by Ms K Hill.

The Judges placings in this race were as follows:

1st – Sonofanearl (6)
2nd - Biddy Bid (17)
3rd - Blackjacky (2)
4th - Pammys Boy (14)
5th - Seppl (3)
6th - Natives Brite Spark (12)

The Information reads as follows;

“In the run home “Seppl” has drifted up the track resulting in “Ruby N Diamonds” contacting its sulky wheel breaking”

Rule 869 (8) provides as follows:
The Judicial Committee may in addition to any other penalty which may be imposed pursuant to Rule 1003 thereof place any horse which,
(a) may have gained an advantage by any contact or interference prohibited by any preceding provision of this Rule and/or
(b) may have interfered with, or whose horseman may have interfered with the progress or chance of any other horse or horses-
(c) immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby”

The Respondent had endorsed the information “The connections do not contest the protest”.

Submissions for Decision:

Stipendiary Steward Mr McIntyre used race video footage over the concluding stages of the race to illustrate the interference. He submitted that when “Ruby N Diamonds” began to move into a gap on the outside of “Seppl”, “Seppl” moved approximately ½ a sulky width up the track causing the improving “Ruby N Diamonds” to strike the sulky wheel of “Seppl”. “Ruby N Diamonds” went into a break and as a result lost all chances. Mr McIntyre’s submission was that “Ruby N Diamonds”s driver Ms Hill was entitled to take the line which she had.

Mr McIntyre made a submission that “Sepple” should be relegated to 10th place behind “Ruby N Diamonds”.

Reasons for Decision:

The connections did not contest the protest and we were satisfied that interference had occurred. We found that “Ruby N Diamonds”s progress and/or chances had been adversely affected as a result.
