As the breach was admitted we find the charge proved.

After taking all the above factors into account we impose a fine of $350.

Facts:

Following race 3 Mr M Williamson alleged that Mr S Ralph, trainer of LUCKY ORDER, omitted to add a towel when saddling.

Submissions for Decision:

Mr Williamson explained to the committee that upon LUCKY ORDER weighing in after race 3 it was discovered that it's rider Mr R Hutchings was just under 1/2 kilogram below the carded weight.  It was subsequently found that the reason for this was that the trainer Mr S Ralph had omitted the inclusion of 1 towel.

Mr Ralph in admitting the breach acknowledged it was his responsibility to ensure his horses raced in all the weighed out gear.  He explained that he had 2 horses in the race and was assured by his employee that the omitted towel was not part of the weighed out gear.  Mr Ralph said that as he had 2 horses in the race he did not double check LUCKY ORDER'S gear.

Submissions for Penalty:

Mr Williamson submitted that this was Mr Ralph's second charge under this rule in the last 12 months.  However he said Mr Ralph had been fully cooperative with the stewards and submitted a fine in excess of the $250 fine he had incurred last time would be appropriate.

Mr Ralph pleaded for leniency as stakes were low at the moment.

Reasons for Penalty:

The committee considered all evidence and submissions before imposing an appropriate penalty.  Mitigating factors are Mr Ralph's admission of the breach and his full cooperation surrounding the charge.  It is also relevant that the horse did not have to be disqualified as it was just under the allowable 1/2 kilo.  However the aggravating factor in this case is that this was Mr Ralph's second charge for the same offence.  Any gear omission is serious because of the repercussions that could arise.
