The Protest is upheld and KOWHAI MONARCH is disqualified from 4th position and the race.

The amended placings are now : 1st (11) EVERYBODY KNOWS

                                                   2nd (8) TOURMALET

                                                   3rd (5) WINGS ON FIRE

                                                   4th (1) LA MAITRE DIX

                                                   5th (7) GOTTA GO TWINKLE

It was ordered that dividends and stakes be paid in accordance with the amended placings.

Facts:

Following the running of the Crombie Lockwood Trot an Information was lodged against the 4th placing of KOWHAI MONARCH on the grounds of breaking soon after the start and galloping in excess of 150 metres and therefore it was in breach of the Breaking Horse Regulations. The Informants were Stipendiary Stewards Mr JM Muirhead and Ms PJ Kinsey.

Mr Z Butcher the Driver of KOWHAI MONARCH on behalf of the Trainer Mr M Jones endorsed the Information with the words " I do not contest the Protest ".

Rule 870(3) provides "any horse which breaks from its gait shall promptly regain its proper gait".

The Breaking Horse Regulations provide: "that any horse which breaks from its gait and continues in a break in excess of 150 metres or greater shall be deemed to be in breach of Rule 870(3)."

Ms Kinsey demonstrated the incident by use of the Race films and showed where KOWHAI MONARCH broke soon after the start and continued in a break for about 250 metres.

Ms Kinsey submitted that because KOWHAI MONARCH galloped in excess of 150 metres it was in breach of the rule and should be disqualified from the race.
