Penalty:

Miss Grylls this committee suspends you from race riding for a period of 5 North Island days. We have agreed to your request for a 7 day deferment to allow you to fulfil riding engagements.

The period of suspension will begin after the completion of racing on Wednesday January 2nd 2013 and end after the completion of racing on Thursday the 10th of January 2013.

Those days are: Whangarei 3rd, Otaki 4th, Thames/Woodville 5th, Rotorua 7th, Waikato 10th.

Facts:

Apprentice Jockey Miss B Grylls, represented by Mr G Searle (Trainer), admitted a breach of rule 638 (1) (d) in that as the rider of 'Masih Chiantik' she allowed her mount to shift out tightening 'Down Town', 'Mint', 'Wilber', 'Kitch', 'The Batchelor' near the 300 metre mark.

Submissions for Decision:

Mr Goodwin using the available films indicated the incident that occurred at about the 300 metre mark. Miss Grylls made a run for herself when not sufficiently clear causing a chain reaction to the horses on her outside. The immediate horse on her outside ‘Down Town’ was entitled to be where he was and may have moved fractionally as Miss Grylls made her run. He reiterated however that Miss Grylls was not sufficiently clear when angling her mount to make her run.

The five horses on her immediate outside all received to various degrees some interference.

Mr Searle on viewing the films commented that although the charge was admitted he felt that 'Down Town' may have come out a little contributing to the incident.

Miss Grylls informed the committee that at the top of the straight she didn’t have a run and she pushed up, not realising that the horse on her immediate outside 'Down Town' was where he was.

Submissions for Penalty:

Mr Goodwin submitted that the incident looked possibly worse than it was, because of the effects to five horses. The initial movement from Miss Grylls was not severe but her movement outwards did cause inconvenience to all those horses.

He classed the incident in the mid range. This was, he told the committee, Miss Grylls first breach of this rule. She has had so far in her career approximately 180 rides and has been riding for about one year. He believed the breach could be best handled by a period of suspension of between 4 – 5 days. Miss Grylls, he added, rides only in the North Island.

Miss Grylls had no comment except to say it was a busy time of the year for her as a jockey, that she was aware of the deferment rule, and that in the advent of any suspension being imposed asked for it to begin in 7 days time.

Mr G Searle asked the committee to take into account Miss Grylls record and the length of time she has been riding.

Miss Grylls in coming to our decision to impose a period of suspension for this breach we have taken into account your very good record (no previous charges under this rule) and your admittance of the breach. However, while the incident may have on film looked worse than it was, the effects to the five horses on your outside was due entirely to your actions.

There may have been some small contributing actions to the incident by 'Down Town' but the fact remains you were not sufficiently clear when making your run.

We have started in our deliberations on penalty from a point of 5 days suspension. Because of the number of horses effected by your actions we have added 1 day which we have subsequently reduced to reflect your very good record and your admittance of the breach.
