As the breach was admitted we find the charge proved.

Accordingly, after taking all the above into account, and under the provisions of rule 1106(2) we suspend Mr Cameron from riding in races which is to start after racing on 9 March and conclude after racing on 16 March 2013 (4 days). The Waipa meeting on 14 March has not been considered as this meeting has been cancelled.

Facts:
Following race 6 an information was filed pursuant to rule 638(1) (d). Mr Neal alleged that near the 450 metres Mr M Cameron angled his mount outwards when not clear of EKRAAR SUPERIOR (V Colgan) which was checked.
Submissions for Decision:
Mr Oatham demonstrated the video films pointing out AMBITIOUS CHAMPION racing on the rail approaching the 450 metres. EKRAAR SUPERIOR was racing directly behind Mr Cameron at this point. Mr Oatham submitted that Mr Cameron then angled his mount out to a position 4 off the rail. In doing so he moved into the line of EKRAAR SUPERIOR when insufficiently clear causing that runner to be checked.
Mr Cameron said he was held up on the rail and before moving out looked to his side. He said at this time the horse in front of him moved out slightly but as he was going strongly his mount reacted more quickly than he anticipated. He added that his mount was racing greenly but admitted putting Mr Colgan in an awkard position.

Mr Neal produced Mr Cameron's record which showed 2 suspensions in the last 12 months indicating a very good record. He said Mr Cameron did look before he moved out but had over-cooked the movement. He believed the breach to be in the mid-range.
Mr Cameron said he had commitments up to and including 9 March and he rode all over the country.
Reasons for Penalty:
The committee carefully considered all evidence and submissions. In mitigation Mr Cameron has a very good record and he has admitted the breach. However the aggravating factor is the bad checked received by Mr Colgan caused by Mr Cameron coming out when insufficiently clear. We independently assess his carelessness at the low to mid-range. The committee has adopted a starting point of 5 days and because of Mr Cameron's excellent record for the large number of rides he has and his admission of the breach we find the appropriate penalty is a 4 day suspension.
