As Mr Jones admitted the breach it was found to be proved.

Mr Jones’ Jockeys Licence was suspended from the close of racing on 2 January 2013 up to and including racing on 7 January 2013 (4 days).

Facts:
Following the running of Race 7 Information A2074 was filed by Stipendiary Steward Mr J Oatham under Rule 638(1)(d). The Information stated that Mr Jones permitted his mount to shift outwards when there was insufficient room to do so causing interference to Veldt near the 50m.
Mr Jones acknowledged that he understood the rule and the charge.
Submissions for Decision:
Mr Oatham used the head and side-on films to show the incident. Mr Oatham said that inside the 100m there was not a run available to Mr Jones and his mount, Runaway Bride and that Mr Jones forced a run for himself and in doing so caused interference to Mr Bosson’s mount, Veldt.
Mr Jones said that he came out thinking that there was a gap ahead, but that the horse on the inside came out and that he was going to clip heels and he had to take evasive action.
Submissions for Penalty:
Mr Oatham said that Mr Jones had a clear record for the last 12 months. He put the carelessness at the low to mid-range and asked the committee to be mindful of the consequences of the careless riding which resulted in his mount being relegated from 2nd to 3rd when fixing penalty.
Mr Jones said that he had not been penalised for careless riding for 18 months and on this occasion he did not put any rider in danger and asked that if a suspension was to be imposed that it start after racing on 2 January 2013. Mr Jones advised the committee that he did not intend riding in the South Island.
Reasons for Penalty:
The committee took into account Mr Jones’ excellent record, the admission of the breach, and that the carelessness was in the mid-range. Also that the consequences of the carelessness resulted in a relegation. Under normal circumstances a 6 riding day suspension would be imposed, however due to the mitigating factors the committee determined that a 4 riding day suspension was appropriate.
