As the breach was admitted it was found to be proved by the Judicial Committee.

Mr Tanaka was fined $300.

Facts:

Following the running of Race 6 (Riverstone Café Handicap) Information No. A8761 was filed with the Judicial Committee. It was alleged that Mr Tanaka used his whip excessively prior to the 200m without the necessary respite on his mount WENTWORTH.

Rule 638(3)(b)(ii) provides:
A rider shall not: strike a horse with a whip in a manner or to an extent which is: excessive

Mr Tanaka acknowledged that he understood the Charge, the Rule and confirmed that he admitted the breach. He also advised the Committee that he understood the Whip Guidelines.

Mr Balcombe showed all film replays and identified that Mr Tanaka had hit his mount WENTWORTH 10 times prior to the 200m.

Mr Goodwin said that Mr Tanaka had only given a brief respite of 2-3 strides during his whip use.

Mr Tanaka for his part said that his horse was lazy and that he kept hitting and forgot about the Rules. He said that he agreed with the Stipendiary Stewards interpretation of his whip use.

Submissions for Penalty:

Mr Goodwin said that Mr Tanaka had a very good record and submitted that a fine be imposed.

Mr Tanaka had nothing further to add.

The committee when fixing quantum of penalty took the following matters into consideration:

- Admittance of the breach

- Excellent record

- The number of strikes (10)

- The JCA starting point of $500

- The penalty submission

It was determined by the Judicial Committee that a fine of $300 be imposed.
