As Mr Bosson admitted the breach we find the charge proved.
Penalty:
We grant Mr Bosson’s request to seek a deferment to his suspension as per rule 1106(2).
Accordingly, we impose a suspension on Mr Bosson which will commence after racing on 20th February and conclude after racing on 25th February 2013 (4 days).
Charge:
Following race 7, an information was filed pursuant to Rule 638(1)(d). The informant, Mr Oatham alleged that near the 200 metres Mr Bosson permitted his mount USANITY to shift in when not clear of ROAMIN (M Du Plessis) who was dictated into the line of TYPHOON (C Grylls) which was checked.
Mr Bosson acknowledged that he understood stood the rule.
Facts:
Mr Williamson demonstrated the incident by using all the available films. He paused the video at the 300 metres to identify USANITY was racing in a 3 wide position with ROAMIN to his inside and TYPHOON adjacent to the rail. He said shortly after this point USANITY started to run out which resulted in Mr Bosson changing his whip over to the left hand. When struck with the whip USANITY shifted in and dictated ROAMIN into the running line of TYPHOON which reacted poorly. He said TYPHOON did not have the best manners however noted Mr Bosson had a duty of care when shifting ground.
Mr Bosson informed the Committee that his mount was laying out and he changed his whip over. However, in doing so his mount rolled into ROAMIN'S running line. He said Mr Du Plessis called out to him but he conceded he did not react fast enough.
Submissions for Penalty:
Mr Oatham produced Mr Bosson's record which showed 3 previous breaches under this rule in the last 12 months. He said one of these suspensions was in Australia and the 2 NZ suspensions resulted in 4 day penalties. He said the level of carelessness was at the low end noting that Mr Grylls' mount reacted poorly to the incident. He said Mr Bosson should be given credit for his admission of the breach. He submitted Mr Bosson was a leading rider with a good record and a 4 day suspension would be an appropriate penalty.
Mr Bosson submitted he had commitments up to and including February 20 and requested his proposed suspension start after that date.
Mr Bosson submitted that he been offered the ride on his manager's horse ISHIMINE at Christchurch on the 22nd of February.
The Stewards did not object to Mr Bosson's submission regarding Christchurch.
Reasons for Penalty:
The committee carefully considered all the evidence and submissions presented. We have adopted 5 riding days as the starting point in considering the term of suspension for this careless riding charge. The mitigating factors are Mr Bosson's admission of the breach, his very good record and we independently assess his level of carelessness as low range. The aggravating fact was 2 horses to his inside received minor interference. We note that Mr Grylls' mount did react abruptly to the incident.
The Committee accepts that ISHIMINE did race at Invercargill yesterday. When questioned by the Committee Mr Bosson confirmed the connections intended to race again on the 22nd of February.
We are aware Mr Bosson’s manager is involved in the ownership of ISHIMINE.
Taking into account all the above factors we assess an appropriate penalty is a suspension of 4 days.
