Facts:
SCOTT THE LOOKS was not eligible to race in a Class 1 race as he was still a Class 2 dog and had been incorrectly graded Class 1 by NZGRA.
The hearing was held prior to race 1 at the Waipukurau race course on Sunday 4th December.
Evidence:
Stipendiary Steward, Mr G Whiterod informed the committee that because of the breaking of rules 90.1C, 91.2A and the 7th schedule provisions 1, 2 and 3 he had lodged an information seeking disqualification of the dog SCOTT THE LOOKS.
A letter tabled by Mr M Godber (RIU) authorising the lodging of the information was tabled.
A letter from Mr S Cashen (Racing Manager NZGRA) was also tabled stating the dog concerned was downgraded by the system after three unplaced runs from Class 2 to Class 1. It appears to be a system problem and the matter has been referred to the IT provider to be investigated.
The relevant rule reads ‘Any objection on the grounds of misstatement or omission in any entry or on the grounds that the greyhound which competed was not the greyhound nominated or that such greyhound was not qualified under the conditions of the race’.
Mr Whiterod informed the committee that all connections had been spoken to and all had understood and agreed to the course of action that was being followed. He stressed that it was a system problem of NZGRA that had brought this problem to a head and was currently being worked on. The dog concerned had finished third in the race and stake money of $300 was paid out. No request for a refund of the stake money was being sought as the problem was caused by the IT provider.
Decision:
The committee after hearing all the evidence agreed that SCOTT THE LOOKS be disqualified.
Costs:
No requests for costs were tabled from the RIU or the JCA as the hearing was held on a race day.
