As Mr Muniandy has admitted the breach, it is found proved.
Penalty:
The penalty is thus 7 national riding days. The suspension commences on the conclusion of racing on 28 December 2017 and concludes after racing on 4 January 2018.
Facts:
Mr McLaughlin filed an Information alleging Mr Muniandy (BAKELA) rode carelessly when he allowed his mount to shift out forcing I’M HORACE (S Wynne) outwards into the line of THE MAN (J Lowry) which was checked passing the 220 metres in Race 5, the MK FITNESS 1500 metres.
Mr Muniandy admitted the breach.
Mr Davidson, Stipendiary Steward, demonstrated on the video replays that BAKELA was racing to the inside of I’M HORACE about 200 metres from the winning post when he angled out for a run and took the line of that horse. He bumped I’M HORACE outwards and THE MAN had to check off the heels of I’M HORACE.
Mr Muniandy said he was following the leader ridden by Ms Barnes, which had rolled out from the fence. He agreed with the Committee that this horse had only come out a little.
Mr McLaughlin also emphasised that Ms Barnes had only shifted out minimally. He also stated that the respondent was always looking for a run to her outside.
Submissions for Penalty:
Mr McLaughlin produced the respondent’s record which evidenced a suspension on 18 November at Riccarton, where the penalty was 11 days’, and suspensions in March and April this year.
Mr McLaughlin said that all the respondent had to do was wait and take a run that would have become available on the rail. He described the breach as mid range. Two horses had been inconvenienced.
Mr Muniandy said he had made a misjudgement.
Reasons for Penalty:
We agree with Mr McLaughlin that this breach is mid-range. We take a starting point of 8 national riding days. We have contemplated increasing this starting point due to this being the respondent’s second breach of this rule today. We are aware the previous penalty was a “stiff one” with respect to the number of South Island days that is encompassed by it, and are surprised that the respondent did not learn from this. However, we refrain from an increase. His admission of the breach results in a one day discount.
