Penalty:
This penalty is to commence after the conclusion of the suspension Mr Yanagida incurred on 26 September at Matamata RC.
Accordingly, Mr Yanagida had his license to ride in races suspended for a period to commence after racing on 12 October and conclude after racing on 19 October 2018.
Facts:
Following the running of race 3, Westbrook. CO.NZ 1200, an Information was filed pursuant to Rule 638(1)(d). The Informant, Mr Williamson, alleged that Mr Yanagida allowed his mount FORTUNE PATCH to shift in when not sufficiently clear of SHADOW DANCER which was hampered losing ground near the 1100 metres.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Yanagida said he understood the Rule and confirmed he admitted the breach.
Mr N Harris assisted Mr Yanagida at the hearing.
Mr Jones demonstrated the incident using the available video footage. He identified that near the 1100 metres Mr Yanagida was riding forward when angled his mount in towards the running rail. He said in doing so he was no more than ¾ of a length clear of SHADOW DANCER which was hampered losing ground. He said Mr Yanagida attempted to straighten his mount but it was too late.
Mr Yanagida accepted Mr Jones assessment of the incident and had nothing further to add.
Mr Harris said that Mr Jones assessment of the incident was correct.
Submissions for Penalty:
Mr Williamson said that Mr Yanagida breached this Rule for the first time on the 26th of September 2018. He said the level of carelessness on this occasion was low range and Mr Yanagida did attempt to straighten his mount albeit it was too late. He said Mr Yanagida misjudged the situation and his overall record was good. He submitted a low end suspension would be appropriate.
Mr Williamson confirmed that Mr Yanagida was suspended from the close of racing today up to and including 12 October from the careless riding breach on 26 September. .
Mr Harris said that Mr Yanagida was very concerned that he breached the careless riding Rule twice in one week and he would learn from the experience.
Reasons for Penalty:
The Committee carefully considered all the evidence, submissions presented and reviewed the video films.
The Committee found that Mr Yanagida allowed his mount to shift in too quickly 100 metres after the start. In doing so Mr Yanagida was only ¾ of a length clear of SHADOW DANCER which had its rightful running taken, losing ground. We accept that Mr Yanagida did take some corrective action but it was too late to avoid causing the interference. The Committee deemed the level of carelessness displayed by Mr Yanagida was low range.
The JCA Penalty Guide starting point for low range carelessness is 6 days which was adopted.
There were no aggravating factors.
The mitigating factors were Mr Yanagida’s admission of the breach and his overall good record. For these combined factors Mr Yanagida was afforded a 1 day reduction in penalty.
After taking into account all the above factors the Committee considered that an appropriate suspension was 5 national riding days.
