The Committee was satisfied after reviewing the video footage ,and in particular the back view footage, that Mr Shirley has made an error of judgment.

Penalty:

The committee fined Mr Shirley $250.00.

Facts:

At the conclusion of race 6 (Kina Craig Mobile Pace) Stipendiary Steward Mr P T Knowles lodged an information 67448 alleging that with approximately 300 metres to run B R Shirley (Turbine) shifted outwards causing interference to Hot Ripple (A J Suddaby),Felix Hanover (B M Norman) and other runners.

Submissions for Decision:

Mr P T Knowles (Stipendiary Steward) and Mr B R Shirley did not wish to add to any of the statements that had already been made in the former protest hearing (information 13356).

Reasons for Decision:

Clearly it is the committee’s opinion that he has moved Turbine out when he was not sufficiently clear coming into contact with Hot Ripple (A Suddaby) who in turn interfered with Felix Hanover (B M Norman).

Submissions for Penalty:

Mr Knowles stated that Mr Shirley has no previous breaches under this rule in the past twelve months.
 
Mr Knowles also stated that he believed the breach was at the low end of the scale, although two horses lost their chances as a result of the interference.
 
Mr Shirley stated that he wished the committee to consider when fixing penalty his clean driving record.

In fixing penalty the committee credits Mr Shirley for his driving record over the previous twelve months and believes on this occasion a simple error judgement had been made.
