Horse late onto track. 

Facts:

Following the running of Race 2, Bishopdale-Bush Inn TAB’s Amateur Drivers Mobile Pace, an information was filed by Stipendiary Steward, Mr S W Wallis, against Licensed Public Trainer, Miss J A Law, alleging that Ms Law, as the trainer of DARRYL HANOVER in the race, “was late presenting DARRYL HANOVER into the birdcage and onto the race track”.

Miss Law was represented at the hearing of the information by stable representative, Mr B Williams. He indicated that the charge was admitted.

Mr K G Hales stood down from the Committee because he had previously acted for Mr Williams in a professional capacity.

Rule 858 provides as follows:

Every horseman and/or person in charge of a horse shall ensure that:-
(b) the horse is on the race-track at least ten minutes before the time of starting, and at the post ready to start at least five minutes before the time of starting, or such other time as the starter may direct.

Submissions for Penalty:

Mr Wallis told the Committee that breaches of this Rule were normally dealt with under the Minor Infringement System. However, on this occasion, the Stewards were proceeding under Rule 1105A (2) as they considered that the breach was of such significance that a more substantial penalty that the $200 fine was warranted.

Mr Wallis said that Mr Williams was in charge of DARRYL HANOVER for the meeting. Approximately 2 minutes prior to start time, the horse had still not been presented into the parade ring. Stewards were on the point of late-scratching the horse. With less than a minute before start time, Mr Wallis said, he noticed the horse. It was presented onto the track at 12.51pm, 1 minute after official start time.

Mr Williams said that he had arrived on course with the horse at 11.30am (1 hour 20 minutes before the race). He said that he had geared the horse up before discovering that there was no bridle. The horse was to wear sliding blinds. Instead of borrowing a bridle from another trainer, he elected to send Miss Law’s daughter home to collect the bridle, he said. She did not get back in time, he said. 

Reasons for Penalty:

The Committee took, as a starting point for penalty, the fine of $200 under the Minor Infringement System. It accepted that a larger fine was called for in the circumstances. The efficient running of a race meeting requires all trainers to present their horses on the track in a timely manner. To present a runner onto the track 1 minute after the official starting time for the race amounts to a quite serious breach of the Rule and the penalty must reflect that.
