Following the running of Race 5 (HANLEY FORMULA PREMIER), Information No A12118 was filed with the Judicial Committee. It was alleged by the Informant that Mr Johnson used his whip excessively prior to the 100m.
Mr Johnson said that he understood the Whip Rules and confirmed to the Committee that he admitted the breach.
Mr Goodwin, Stipendiary Steward showed the film replays and said that Mr Johnson had hit his horse 12 times without the required respite of 5 strides prior to reaching the 100m.
Mr Johnson agreed with the Stipendiary Steward’s interpretation of the whip use. He said that it is a long straight and a bit deceiving.
Submissions for Penalty:
Mr Oatham said that Mr Johnson’s record was clear insofar as the whip was concerned and he placed the excessive whip use in the mid-range category. He submitted that a fine would be a suitable penalty.
Mr Johnson did not comment when given the opportunity to do so.
Reasons for Penalty:
Mr Johnson has had a very good record over the past 12 months regarding whip use and after taking into account the penalty guidelines it was determined that a fine of $300 was an appropriate penalty.
