As Mr Haruki admitted the breach it is found proved.

Mr Haruki is suspended for 4 riding days from the close of racing today, Friday 04 July 2014 to the close of racing on Monday 28 July 2014 – the 4 days being Timaru (11 July), Oamaru (20 July), Ashburton (25 July) and Wingatui (28 July).
Facts:
Following the running of race 1 the "Plumbing World Ashburton Rating 75 2100m”, Information A6151 was filed by Stipendiary Steward Mr N Ydgren under Rule 638(1)(d). The information stated “passing the 400m M Haruki the rider of “Umshini Wami” permitted his mount to shift inwards when not clear of “Enchanter (K Williams) which had to check and steady”. Mr Haruki signed the Information stating he admitted the breach and at the beginning of the hearing confirmed that was correct and also that he understood the rule under which he was charged.
Rule 638 (1) (d) states “A rider shall not ride a horse in a manner which the Judicial Committee considers to be .....careless”.
Submissions for Decision:
Mr Ydgren, using the head-on film, highlighted Mr Haruki riding approximately 2 horse widths off the rail at the top of the straight leading the race with Ms Williams positioned behind him against the rail. He said as Ms Williams moved up inside of Mr Haruki he had shifted in under pressure and caused her to take a hold and steady her horse. He said Mr Haruki did take immediate corrective action but Ms Williams was clearly established to his inside and had her rightful line of running taken.
Mr Haruki agreed with the Mr Ydgren’s comments and had nothing else to say.
Mr Hughes said that “Umshini Wami” was a difficult horse to ride and Mr Haruki had done a great job up to that point of the race when he couldn’t hold him any longer. He said Mr Haruki and had tried his best to keep the horse straight.
To a question from the Committee Mr Haruki confirmed that Ms Williams did call out to him as he moved in and that on hearing her he immediately took corrective action. He also said, however, that prior to hearing her call out he didn’t realize she was to his inside.
Submissions for Penalty:
Mr Ydgren said Mr Haruki had previously breached this Rule at Riverton on 19 April 2014 when he received a 2 day suspension. He said the Stewards considered the severity of the interference to be at the low end and agreed that the horse was difficult to ride but the onus was on Mr Haruki to ensure he maintained a straight line at all times during the race. He said consideration should be given to Mr Haruki for admitting the breach and he submitted that a suspension of 2 riding days was an appropriate penalty.
At this point the Chairman pointed out to Mr Ydgren that the JCA’s penalty listing showed that Mr Haruki had in fact been suspended twice at the Riverton meeting on 19 April and that on the first occasion he was suspended for 2 days but on the second occasion because of the seriousness of the offending he was suspended for 5 days. Mr Ydgren then checked his records and confirmed this was correct and apologized for the oversight. He was then asked if, in light of this new information, he wished to change anything in his submissions on penalty but said he didn’t want to.
Mr Haruki confirmed that he had been suspended twice at Riverton on 19 April. He did not seek a deferment of any suspension that might be given.
Mr Hughes thought a 2 day suspension was appropriate given the interference was at the low level. He also reminded the Committee of the limited opportunities for jockeys in the South Island at this time of year.
Reasons for Penalty:
The Committee has reviewed films of the incident and taken into account all the submissions made. The films clearly show that at the top of the straight Mr Haruki, who was racing 2 off the rail and leading the race, moved inwards onto “Enchanter” ridden by Ms Williams. At that point in the race Ms Williams was clearly only about half a length behind Mr Haruki and when she called out to him he took immediate corrective action. That inward movement, did however, cause her momentarily to have to check and steady her horse. The Committee notes that Mr Haruki stated that he did not realize Ms Williams was to his inside until he heard her call out. It is perhaps fortunate that Ms Williams is an experienced jockey as the consequences, had there been an inexperienced rider to Mr Haruki’s inside, could have been much worse.
The JCA’s Penalty Guidelines state the starting point for a breach of the careless riding rule is 5 riding days. We have taken into account Mr Haruki’s admittance of the breach and agree that the severity is at the low end. However this is his fourth breach of the Rules in the last 12 months and comes less than 3 months after he was suspended twice on one day at Riverton in mid April.
The Committee believes the interference caused, and his recent riding record, must be reflected in an appropriate penalty which we have decided is a period of suspension. From a starting point of 5 days we have reduced that by 1 day because of his admittance of the breach. We have also reviewed the JCA’s list of penalties imposed under this Rule in the past 18 months on jockeys who only ride in the South Island to ensure, as best we can, a general consistency with those decisions.
