As Mr Johnson admitted the breach we find the charge proved.
Penalty:
In assessing penalty the Committee took into account Mr Johnson was to commence a suspension after racing today until the close of racing on December 6th 2013.
Accordingly, we impose a suspension on Mr Johnson which will commence after racing on 6 December and conclude after racing on 16 December 2013 (6 days).
That period of suspension encompasses meetings at Wellington on December 7, Waipukurau on December 8, Dunedin on December 9, Hastings on December 12, Invercargill on December 14 and Dunedin on December 16.
Facts:
Following race 6, NRM/AUCKLAND THOROUGHBRED BREEDERS STAKES GROUP 2, an Information was filed pursuant to Rule 638(1)(d).The Informant, Mr Oatham, alleged that near the 1200 metres Mr C Johnson (FINAL TOUCH) allowed his mount to shift in when not clear of MELODY CELEBRE(A Collett) which was checked.
Mr Johnson acknowledged that he understood the nature of the charge, the Rule and confirmed his admission of the breach.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr McIntyre identified near the 1200 metres Mr Johnson directs his mount in abruptly when not the required distance clear. This caused a check to Ms Collett’s mount which lost at least 1 to 2 lengths.
Mr Johnson said after viewing the films he realised he shifted ground inwards and had misjudged the manoeuvre. He acknowledged this placed Ms Collett in a tight situation.
Submissions for Penalty:
Mr Oatham produced Mr Johnson’s record which showed 4 previous breaches under this Rule in the last 12 months. He submitted that this was Mr Johnson’s 3rd breach in the last 10 days and it does not reflect well on his overall record. He submitted Mr Johnson admitted the breach and co–operated with Stewards and ought to be given credit for this. He further submitted that Mr Johnson shifted in abruptly and therefore described the incident as mid-range. He noted an aggravating factor was the status of the race (Group 2, $100,000 stake) and on that basis the Stewards were seeking a suspension in the 6 to 8 day range.
Mr Oatham advised the Committee that Mr Johnson is to commence a period of suspension after racing concludes today through to the 6th of December 2013.
Mr Johnson after viewing the video films acknowledged that Ms Collet did have to ease back as a result of his actions.
Mr Johnson submitted a suspension in the range of 3 to 4 days would be appropriate.
The Committee advised Mr Johnson they were proposing to treat him as a South Island and Central Districts rider when assessing penalty. In response Mr Johnson conceded that he only rode in the Auckland area on rare occasions when he was offered sufficient mounts to justify the costs of travelling.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented. We have adopted 5 riding days as the starting point in considering the term of suspension. The mitigating factor is Mr Johnson’s admission of the breach. The aggravating factors are the status of the race (Group 2 carrying a stake of $100,000) and we assess Mr Johnson’s record is below average given this is his 3rd breach of this Rule in the last 10 days and his 5th in the last 12 months.
We assess the level of carelessness as low to mid–range noting that 1 horse was affected by Mr Johnson’s actions. We note that Mr Johnson did shift in abruptly shortly after the start which caused Ms Collett’s mount to lose 1 to 2 lengths.
We referred to JCA listing of penalties for similar Group 2 races which indicated that generally breaches of this nature incurred a 6 day penalty.
The Committee explained in detail to Mr Johnson that it is our policy to test riders firmly of their riding history and upcoming commitments. We note that Mr Johnson has no history of riding at Ellerslie or Tauranga at industry or feature meetings. Therefore race meetings on December 11, 13 and 15 are not included in Mr Johnson’s penalty.
We accept on rare occasions Mr Johnson will ride in the northern area, primarily to ride the class mare FINAL TOUCH.
After taking into account all the above factors we consider an appropriate penalty is a 6 day suspension.
