As Ms Chiong admitted the breach we find the charge proved.

Charge:
Following race 4, United Gaming Ltd Premier, an Information was filed pursuant to Rule 638(3) (b). The Informant, Mr Oatham, alleged that Ms Chiong used her whip excessively prior to the 200 metres on her mount DANROSE.
Ms Chiong acknowledged that she understood the Rule and the nature of the charge and was assisted by her employer Mr Richardson.
Rule 638(3)(b) states: A Rider shall not strike a horse with a whip in a manner or to an extent which is unnecessary, excessive or improper.
Facts:
Mr Coles demonstrated on the video films that Ms Chiong used her whip 11 times prior to the 200 metres.
Mr Richardson, on behalf of Ms Chiong, informed the Committee that she hit her mount for 3 strides then put the whip away for 1 stride. He acknowledged this was outside the guidelines and would explain the Rule again to Ms Chiong to ensure compliance in the future.
Submissions for Penalty:
Mr Oatham produced Ms Chiong's record which showed she had ridden in 67 tote races and had a clear record under this Rule. He submitted the breach was at the low end and an appropriate penalty for the inexperienced rider would be a $150 fine.
Mr Richardson submitted that Ms Chiong would learn from her experience and accepted a low fine was appropriate.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented. The mitigating factors are Ms Chiong's admission of the breach, her inexperience and her clear record under this Rule. The number of strikes (11) is assessed as low range and the severity is assessed as low range.
We note that Ms Chiong did not give her mount the required 6 strides respite when using her whip.
We referred to the JCA listing of penalties for similar breaches which showed fines ranged from $150 to $200.
After taking into account all the above factors we consider an appropriate penalty is $150 fine.
