As Mr Bradley admitted the breach the charge was deemed proved.

Accordingly Mr Bradley’s jockey’s license is suspended from the close of racing on Monday January 7th up to and including racing on January 15th 2019.
Facts:
Following the running of Race 1 (Bell Booth/ Plasma Biotec Premier), an Information was lodged by Mr N Goodwin alleging a breach of Rule 638(1)(d) in that D Bradley angled his mount ARIDITY outwards when not sufficiently clear of VIKTOR VEGAS which was checked near the 100 metres.
Mr Goodwin had Mr Oatham show all available films. He identified ARIDITY who had been racing in the trail leading up to the 100m. He said at that point ARIDITY was held up for a run between the two leaders and that Mr Bradley angled his mount outwards for a clear run and in doing so shifted into the line of VIKTOR VEGAS who was checked. He said that when Mr Bradley shifted he was only a bare length clear.
Mr Bradley said that he had been in the trail throughout and that a gap was not presented between the two leaders in the straight. He said he had a quick look behind at which point he was clear of VIKTOR VEGAS, but as he shifted VIKTOR VEGAS closed quickly on his mount, hence he was only 1½ lengths clear, which was not the required distance.

Mr Goodwin presented Mr Bradley’s riding record over the last 12 months. This showed the following suspensions for careless riding:
6/2/18 - 8 days
21/7/18 - 8 days
27/9/18 - 6 days
He placed the degree of carelessness in the low to mid-range and submitted that a term of suspension be imposed.
Mr Bradley said his record shows that he always tries to stay out of trouble both professionally and safely. He advised of riding engagements through until Monday January 7th.

Taking into account the admission of the breach and Mr Bradley’s record the Committee determined that a five riding day suspension was the appropriate penalty.
