Facts:
Following the running of Race 1, an information Instigating a Protest was lodged by Mr Muirhead against the fourth placing of horse number 5 GETAWAY DOUG (A Herlihy), on the grounds of breaking with 150 metres to race and continuing in that break for the rest of the race.
Mr Herlihy, the Driver of GETAWAY DOUG, represented the connections of the horse and endorsed the information with the words "I do not contest the Protest".
Submissions for Decision:
Mr Muirhead demonstrated the incident by use of the video films.The films showed quite clearly GETAWAY DOUG breaking at about the 150 metres from the finish and continuing on in a break for the rest of the race.
Reasons for Decision:
The protest is not contested and clearly the the provisions of Rule 870(3) and the Breaking Horse Regulations apply.
