Following race 8 an information was filed pursuant to rule 638(3) (b). The informant Mr R Neal alleged that Mr Sweeney, rider of MASTER MICHAEL, struck his mount in a manner that was excessive.
Submissions for Decision:
Mr Neal demonstrated the video films and pointed out to the committee Mr Sweeney striking his mount in excess of 11 times before the 200 metres without giving the required respite.
Mr Sweeney in admitting the breach submitted he was not overly excessive and was not a notable user of the whip. He said most of his strikes were back handed.
Submissions for Penalty:
Mr Neal submitted that Mr Sweeney had a clear whip record in the last 12 months and said that today's breach was at the low end.
Mr Sweeney had nothing to add.

The committee has considered the evidence and submissions as presented. In Mr Sweeney's favour are his clear record and his admission of the breach. However as explained to Mr Sweeney animal welfare is of utmost importance which all riders must be aware of.
