Charge:
Mr Wallis, Stipendiary Steward, alleged that Ms Young, Junior Driver, forced ENGLEHURST (R May) to race wider on the track when racing past the 1100m.
Facts:
Mr Wallis demonstrated on the videos that just prior to the 1000 metre mark Ms Young pushed Mr May 2 to 3 wide when the nose of Mr May’s horse had progressed past her cart.
Mr P Young represented Ms Young and said it was “touch and go” and that the defendant was almost within the Rules when she made her move. He asked us to take that into account as a mitigating factor.
Submissions for Penalty:
Mr Wallis produced the defendant’s record, which he described as “outstanding”. She had had 164 lifetime drives and had not previously been charged under this Rule. He submitted that a fine of $200 was appropriate. Ms Young stated she preferred a fine to a suspension.
Reasons for Penalty:
We are aware the “standard penalty” for an admitted breach of the “push out” Rule is $200. We take into account Mr Young’s description of the breach, Ms Young’s excellent record and, in particular, that this is her first breach of this Rule. We also note she is a Junior Driver.
