Miss Haley sought the disqualification of horse 9, PLAYBOY’S BROTHER, placed 5th by the Judge as it galloped in excess of 150 metres near the 1200 metres.

Submissions for Decision:
Mr Munro demonstrated on the videos that PLAYBOY’S BROTHER galloped for approximately 200 metres when in the home straight in the second last lap.
Mr McKay did not contest the protest.
Reasons for Decision:
After viewing the videos, the Committee is satisfied that PLAYBOY’S BROTHER was not in its proper gait for a distance in excess of 150 metres. PLAYBOY’S BROTHER was free of interference at the time. The breaking horse regulations are clear in that the horse is deemed to be in breach of r 870(3) in that it has failed to promptly regain its proper gait.
