As the breach was admitted we find the charge proved.
Penalty:
The committee has adopted 5 days as a starting point in assessing penalty. Because of the mitigating factors described above we find the appropriate penalty is a 4 day suspension. The committee is satisfied that Mr Hutton has been riding recently in the Central Districts on industry days and can be classed as a North Island rider.
Accordingly Mr Hutton is suspended under the provisions of rule 1106(2) from after racing on the 10th April until after the conclusion of racing on the 20th April (4 Days).
Facts:
Following Race 4 The Te Aroha Plumbing & Drainage Ltd 2200 an information was filed pursuant to rule 638(1) (d). The informant Mr J Oatham alleged that Mr B Hutton permitted his mount BACHELOR ZEEL to shift outwards when not sufficiently clear making solid contact with QUINTASTICS near the 400 metres.
The Rule reads as follows: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Williamson demonstrated the video films and pointed out to the committee BACHELOR ZEEL racing in a loose 1 off position on the point of the home turn and at the rear of the field. He also showed QUINTASTICS racing in a 4 to 5 wide position at that same point. Mr Williamson stated that Mr Hutton then allowed his mount to move out and make solid contact with QUINTASTICS which became unbalanced as a result.
Mr Hutton said he was in a tight spot and shifted off heels on the point of the bend. He said he was instructed to give his mount a clear run in the straight but admitted he made an error when moving out and not clear of QUINTASTICS.
Mr Harris acknowledged that Mr Hutton misjudged his movement by half a stride when trying to keep his momentum up.
Submissions for Penalty:
Mr Oatham produced Mr Hutton's record which showed 2 suspensions in the last 12 months, a record he considered to be reasonably good. He said in the Steward's opinion today's breach was towards the lower end and submitted a 4 day suspension would be appropriate. Mr Oatham confirmed that Mr Hutton had been riding recently in the central districts on industry days.
Mr Hutton confirmed to the committee that he did not have any engagements after the Counties meeting on the 10th April and wished to start any suspension after that date.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions as presented. Mitigating factors are Mr Hutton's admission of the breach and his reasonably good record. However we find his level of carelessness in the low to mid range as he came out 4 to 5 horse widths when not the required distance clear of QUINTASTICS. This resulted in solid contact between the 2 horses with QUINTASTICS becoming unbalanced and having her momentun affected.
