As Ms Spratt had admitted the charge, it was deemed to be proved.

Accordingly, Ms Spratt is fined $300.

Facts:

Following the running of Race 3 an Information was filed by Chief Stipendiary Steward Mr J Oatham against Class A Jockey Ms S Spratt, alleging a breach of Rule 638(3)(b) (ii) “Struck her mount ART DE TRIOMPHE excessively prior to the 100 metres”.

Ms Spratt acknowledged that she understood the Rule and confirmed her admission of the breach.

Rule 638(3)(b)(ii) reads as follows:

(3) A Rider shall not:

(b) strike a horse with a whip in a manner or to an extent which is:

(ii) excessive

Mr Oatham demonstrated the incident using the available video footage. He identified Ms Spratt, the widest runner in the home straight, and showed that she struck her mount 8 times prior to the 100 metres. He said Ms Spratt had misjudged the proximity of the 100-metre red rail.

Ms Spratt agreed with Mr Oatham’s assessment and added she thought she may had been over and put her whip away until the last 100 but got it wrong.

Submissions for Penalty:

Mr Oatham stated that Ms Spratt had a clear record under the Rule for the last 6 months.

He said that the JCA Penalty Guide indicated a fine of $300 for a first breach of this Rule and saw no reason to deviate from it.

Ms Spratt had no submissions to make on penalty.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented.

The Penalty Guide is clear and this Committee see no exceptional circumstances to alter the level of fine to be imposed.
