As Mr Bates has admitted the charge it is therefore deemed to be proved.

Facts:

It was alleged that Mr JC Bates, Licensed Jockey ("No Redemption") used his whip excessively prior to the 200 metres.

The incident was shown on the video coverage which revealed that Mr Bates hit his mount approximately 12 times prior to the 200 metre mark, without at any time returning his whip hand to the whip rein as is required by the "Use of the Whip Guidelines".

Mr Bates admitted that his actions were excessive in terms of the guidelines but said that the strikes were on the backhand, and that he did not thrash the horse.

Submissions for Penalty:

Mr Neal advised the hearing that Mr Bates had one previous breach of the rule in the last 12 months, which was on 13th September 2013, when Mr Bates was fined $200. Mr Neal agreed that the incident was at the lower end of the scale. He submitted that a fine in the region of $200 to $400 should be imposed.

Mr Bates had no specific submission to make on penalty.

Reasons for Penalty:

We take as a starting point a fine of $400. There were no aggravating features. The degree of force used by Mr Bates was not great and the strikes were on the backhand. By way of mitigation, we note Mr Bates co-operation with the Stipendiary Stewards and his early admission of the breach. In consideration for these mitigating factors, we allow a discount of $100 on our starting point.
