Facts:
At the conclusion of Race 5, The Big Jim At Alabar Pace, an Information was lodged by Stipendiary Steward, Mr S Renault instigating a protest into third placing by the judge, TOM BOLA (C Thornley) in that with approximately 1400 metres to run TOM BOLA shifted ground outwards forcing OUTA THE FRIDGE (C Barron) wider on the track when not entitled to do so.
Rule 869(a)(2) reads:
When a placed horse or its driver causes interference to another placed horse and the judicial committee is satisfied that the horse interfered with would have finished ahead of the horse that, or whose driver, caused the interference the Judicial Committee must, in addition to any other penalty that may be imposed, place the horse that, or whose driver, caused the interference immediately after the horse interfered with.

Stipendiary Steward, Mr Renault showed the relevant video clip of the incident, which clearly showed TOM BOLA moving outwards forcing OUTA THE FRIDGE from the 3 wide racing line to the four wide line with about 1400 metres to run.
Mr Renault believed that OUTA THE FRIDGE had its chances affected by being pushed wider on the track and the distance between third and fourth was only 1 ¼ lengths.

The committee was satisfied a clear breach of the rule had occurred. TOM BOLA has pushed out forcing OUTA THE FRIDGE into the four wide line forcing him over extra ground. TOM BOLA has finished in third placing and OUTA THE FRIDGE finishing in fourth placing 1 ¼ lengths from third.
