The Committee viewed the various video clips of the alleged incident and were satisfied that ROXY ROCKET had moved inwards and come in contact with VAN EVA , causing VAN EVA to break. The Committee did not believe VAN EVA or Extreme Force contributed in any way towards the incident. The Committee found a breach of the rule had occurred and thus the charge proved.
Penalty:
Mr S Walkinshaw was fined the sum of $250.00 and reminded of his professional obligations on the race track.

At the conclusion of race 5 The Southland Standardbred Breeders ASSN Fillies & Mares Mobile Pace an information (5917) was lodged by Stipendiary Steward Mr C J Allison alleging that Mr S Walkinshaw (ROXY ROCKET) drove carelessly near 400 metre mark when allowing his horse to shift inwards resulting in VAN EVA (Mrs K Barclay) breaking briefly.
The rule reads: 869(3)(b) No horseman in any race shall drive (b) carelessly.
Mr S Walkinshaw did not admit the breach.
Submissions for Decision:
Stipendiary Steward Mr C J Allison showed the Committee several video clips of the alleged incident. Mr Allison stated that Mr Walkinshaw had allowed his horse ROXY ROCKET to move inwards when in the three wide position, coming in contact with VAN EVA (Mrs K Barclay) resulting in VAN EVA breaking briefly.
Mr Allison also stated that VAN EVA recovered from the incident, finishing off the race strongly to finish in second place.
Mrs K Barclay stated that her horse VAN EVA was ‘piggy in the middle’. She had held her racing line and her horse in her opinion did not contribute in any way towards the alleged incident. Mrs Barclay confirmed contact had been made by the two horses. Mr Allison also highlighted the inward, then outward head movement of ROXY ROCKET at the point of the alleged incident, on the video clip.
Mr S Walkinshaw stated that he believed his horse ROXY ROCKET had maintained a straight running line, and that the incident was caused by Extreme Force (Mr B McLellan) who had hit a pylon and then moved outwards slightly onto VAN EVA.
Reasons for Decision:
The Committee was satisfied that Mr Walkinshaw had moved inwards when not clear of VAN EVA causing that horse to break. Contact was clearly made by ROXY ROCKET with no other horse or driver contributing to the incident.

Stipendiary Steward Mr Allison stated that Mr Walkinshaw was a busy driver with 228 race day drives this season. Mr Allison stated that he believed the breach was low to mid range. Mr Walkinshaw gave no submissions on penalty.

The Committee believed the breach of the rule was mid range and in fixing penalty consideration was also given to Mr Walkinshaw's busy driving schedule and no previous breaches under this rule in the past twelve months.
