Facts:

Following Race 7 (NZB Insurance Pearl Series Race 1350) Mr Balcombe lodged an information with the Judicial Committee alleging a breach of Rule 638 (3) (b) (ii) in that R Hannam used the whip excessively prior to the 100 metres on his mount Sophia Magia.

Mr Hannam signed the information indicating that he admitted the breach but did not wish to be present at the hearing.

Mr Oatham played the video of the race from the top of the straight until past the 100m mark. Mr Hannam struck his mount eight times with only a brief pause.

Submissions for Penalty:

Mr Balcombe said Mr Hannam had a clear record over the last 12 months in relation to excessive use of the whip. He said the Stewards considered today’s breach to be low end and submitted a penalty in line with the Penalty Guide be imposed.

The Penalty Guide for Judicial Committees provides the following starting points for breaches of Rule 638(3) (b) (ii):

1st breach                          $300
2nd breach                         $500
3rd or subsequent breach   6-8 national riding days

Mr Hannam has had 464 race day rides in the last 12 months without breaching the whip rules. This is to be commended. The Committee considered the breach to be at the lower end as Mr Hannam was only 3 strikes over the guidelines and he did not use the whip in a continuous manner. There were no aggravating factors to warrant an uplift from the starting point.
