As the breach was admitted we find the charge proved.

Penalty:

Accordingly after taking all the above into account the Committee imposes a suspension on Miss Johnson from riding in races, which is the start after racing on 7 May 2011 and conclude after racing on 14 May 2011 (5) days.

Facts:

Following Race 8 an Information was filed pursuant to Rule 638(1)(d). The Informant Mr J Oatham alleged passing the 400 metres mark, FLORIA, ridden by Miss D Johnson angled out forcing PLATINUM PRINCESS (N Collett) out on HOT IN BLACK (C Ormsby) who had to check.

Submissions for Decision:

Mr C George demonstrated the video films which showed FLORIA racing on the rail, just behind the leader. Soon after the point of turn Mr George pointed out to the Committee Miss Johnson moving her mount forward on the outside of the leader when there was insufficient room to do so. Mr George submitted that Miss Johnson had created her own run.

Miss Johnson submitted that there was a marginal gap for her to take, but that her mount had overreacted to the outward movement.

Submissions for Penalty:

Mr Oatham submitted that Miss Johnson had only incurred 1 suspension in the last 12 months which was an excellent record. However he said in the is case Miss Johnson had created a run when there was insufficient room which resulted in Mr Ormsby receiving quite a severe check. He reminded the Committee this was a Group II race and believed Miss Johnson’s carelessness was in the mid range.

Miss Johnson said she had commitments until the completion of racing on 7 May at Rotorua and she rode over the entire country.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions as presented.

Mitigating factors are Miss Johnson’s excellent record and her admission of the breach. Further the Committee is satisfied that Miss Johnson’s mount did overreact in the incident and she did take corrective action albeit a little late. However she did go for a run when there was insufficient room which caused the check to Mr Ormsby.

Because of the mitigating factors above the Committee believes that normally a 4 day suspension would be an appropriate penalty. However because this interference occurred in a Group II race this term is increased to one of 5 days.
