As Ms Spratt admitted the breach the Committee find the charge proved.

Penalty:

We grant Ms Spratt’s request to seek a deferment to her suspension as per Rule 1106(2).

Accordingly, Ms Spratt had her license to ride in races suspended for a period to commence after racing on 12 March and conclude after racing on 19 March (4 North Island days).

Facts:

Following the running of race 10, Creative Spaces 25th Birthday 2100, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Oatham, alleged that passing the 50 metres Ms Spratt angled HEISTHEONE out to improve when not clear of NEK MINNIT which was checked.

Ms Spratt acknowledged that she understood the Rule and confirmed her admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Coles identified on the video footage that Ms Spratt angled her mount out passing the final 50 metres when not the required distance clear of NEK MINNIT which had to be checked. He said the movement was rapid and acknowledged the horse did go quicker than Ms Spratt had anticipated.

Ms Spratt said she tried to ease out but her mount ducked out quickly which resulted in Mr Lammas being checked.

Submissions for Penalty:

Mr Oatham produced Ms Spratt’s record which showed 6 previous breaches under this Rule in the last 12 months. He said Ms Spratt should be given credit for her admission of the breach and he assessed the level of carelessness as mid – range. He noted the incident occurred in a $50,000 race on an Iconic race day. Mr Oatham submitted a suspension of 4 to 5 days would be appropriate.

Ms Spratt advised that she had upcoming engagements at Ellerslie on 12 March, and sought a deferment to any proposed suspension.

Mr Oatham produced Ms Spratt’s recent riding history which showed that she has ridden all over the North Island in the last 3 months including 4 industry days in the Central Region.

When tested by the Committee Ms Spratt was forthright in that she had no intention of riding at Wyndham or Timaru in the upcoming weeks.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented. The Committee have adopted 5 riding days as the starting point in considering the term of suspension for this careless riding charge. The only mitigating fact was Ms Spratt’s admission of the breach. We assess the level of carelessness to be mid – range which affected NEK MINNIT suddenly close to the finish line. We did not penalise Ms Spratt because the incident occurred in a $50,000 race on an Iconic race day. Ms Spratt’s record is not good and an aggravating fact.

The Committee was satisfied that Ms Spratt has a recent history of riding in the Central Districts on Industry days.

After taking into account all the above factors the Committee considered an appropriate suspension was 5 days. However, a 1 day reduction was fixed after we had regard for the financial impact of Ms Spratt missing a Premier race day at Wellington on 19 March which has total prizemoney of $690,000.
