This Committee fines Mr Reid the sum of $200.00.

Facts:

Following the running of the MAGNESS BENROW HANDICAP TROT an Information was lodged by Chief Stipendiary Steward Mr N Ydgren against Licensed Horseman Mr S J Reid alleging that Mr Reid as the Driver of PUMA ROAD used his whip excessively over the final 400 metres of the Race.

Rule 869(2) provides : No Horseman shall during any race use a whip in a manner in contravention of the Use of the Whip Regulations made by the Board.

Part (b) of the Use of Whip Regulations provides : No horseman is permitted to use their whip in a striking motion on more than 10 occasions inside the final 400 metres. This is inclusive of "backhanders" and the use applies to the horse, harness and/or sulky.

Mr Reid advised the Committee that he admitted the breach and that he did not want to be present at the Hearing.

Mr Ydgren demonstrated the incident by use of the Race films and showed where PUMA ROAD was handy to the lead turning for home and he showed Mr Reid using his whip 12 times in the final straight. He said that this was clearly over the limit.

Submissions for Penalty:

Mr Ydgren submitted that the fine should be $200.00 as provided in the Use of Whip Regulations.

Reasons for Penalty:

Mr Reid has used his whip 12 times in the Home Straight and his horse has run third. Mr Reid has a high whip action and as a result his use of the whip appears to be more pronounced.

He has admitted the breach but that was inevitable bearing in mind the very clear video evidence. We see no reason to depart from the recommended penalty and believe a fine of $200.00 is appropriate.
