Decision:
The protest is dismissed. Authorisation is given to the payments of dividends and stakes based on the judges original placings.
Facts:
Following the running of Race 1, the “Asure Sundowner Motel Trot”, Information A9880 was filed instigating a protest alleging a breach of Rule 870(5). The Informant, Stipendiary Steward Mr Renault, alleged “that the 4th placed horse “Red Hot Rocket” broke inside the final 50 metres and was lapped on by the 5th placed horse “Monaro Mia.
The official placings were:-
1st - Scallywag Sam (4)
2nd - I W McNik (8)
3rd - Dolly Jones (15)
4th - Red Hot Rocket (14)
5th - Monaro Miss (9)
Rule 870(5) states: "Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or its horseman, then (subject to Rule 869A such relegation of the horse shall be at the discretion of the Judicial Committee)".
The definition of Lapped states:- "Lapped On means when a horse has its nose in line with any part of the breaking horse’s body when the nose of the breaking horse reaches the finish line".
Submissions for Decision:
Using the side-on view of the final 100m Mr Renault highlighted “Red Hot Rocket” breaking prior to the finish of the Race and continuing to be in a break as the horse crossed the finish line. He said it was not clear from the film that “Red Hot Rocket” had been lapped on which was why the Stewards had decided to lodge a protest.
Mr Smith said he believed his horse had not been lapped on and when the official photo finish of the race was delivered to the hearing the Committee agreed that was the case. Mr Renault also agreed “Red Hot Rocket” had not been lapped on.
Reasons for Decision:
The official photo finish of the race clearly shows "Red Hot Rocket" was not lapped on.
