Stipendiary Steward Mr T Taumanu lodged an information instigating a protest following race 9.
The protest was against horse 7 Derek Clarke, placed 4th by the judge alleging the horse broke in excess of 50 metres in the final 200 metres of the race.

Rule 870 (3) reads..
‘Any horse which breaks from its gait shall promptly regain its proper gait’
The Breaking Horses Regulation states …
(b) Any horse which breaks from its gait within the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its gait’
Mr S Argue part owner and trainer/driver appeared for the protest and after viewing relevant footage endorsed and signed the information indicating that he did not wish to contest the protest.
Stipendiary Steward Mr J Muirhead in referring to film footage identified Derek Clarke and indicated where the horse broke immediately before the 100 metre mark and continued galloping until approximately 20 metres before the finishing post a total distance of about 80 metres.

The protest was not contested.
Reasons for Decision:
It was clear from the films presented that Derek Clarke had galloped in excess of the prescribed maximum 50 metres within the final 200 metres.
