Accordingly we order PINZEE and SIEM REAP to be declared non runners.
Facts:
Following race 2 an Information was filed under rule 632 requesting a ruling as to whether PINZEE and SIEM REAP were denied fair starts due to the mechanical failure of the starting gates.
Submissions for Decision:
Mr Oatham demonstrated the video films which clearly showed gate 6 from which SIEM REAP started remain closed when all others had opened. He said there was no doubt SIEM REAP was denied a fair start as he lost approximately 5 lengths.
In the case of PINZEE starting from gate 7 it was apparent the gate did open with the others but then sprung back impeding the progress of PINZEE causing it to lose 1 to 2 lengths.
Mr Norvall rider of SIEM REAP confirmed he had been denied a fair start through the gate being slow to open. He said his mount had nothing to do with the incident.
Mr Kasim rider of PINZEE told the committee the gate had sprung back on him causing him to lose 1 to 2 lengths.
Mr Humphries the starter said PINZEE was giving trouble at the time of the gates opening and may have lent on the stall causing gates 6 and 7 to be slow to open.
Reasons for Decision:
The committee reviewed the video footage and considered the evidence. We are satisfied that PINZEE and SIEM REAP were denied fair starts due to the mechanical failure of the starting stalls. We believe this occurrence materially affected the chances of both horses.
