As the charge was admitted it was deemed to be proved by the Committee.

Penalty:

The Committee determined that Mr Pinn’s Apprentice Jockey’s Licence be suspended from the close of racing on 14 June until the end of racing on 27 June 2018.

Facts:

Following the running of Race 4 (Stablebooks Supporting NZ Trainers Mdn), Information No A9227 was filed with the Judicial Committee. It was alleged that Mr W Pinn the Rider of ARABICA failed to ride his mount out fully to the finish when able to do so. (ARABICA was narrowly beaten for 4th and 5th).

Rule 636(1)(d) provides:
A person: being the rider of a horse in a race, must ride his horse out to the end of the race if there is a reasonable chance of it running into a position for which there is prize money to be awarded or a dividend to be declared.

Mr Pinn said that he understood the Rule, Charge and confirmed that he admitted the breach.

Mr Goodwin showed the film replays and identified ARABICA and Mr Pinn as they entered the final straight. He said that over the closing stages Mr Pinn stopped riding his mount out when holding 4th position and as a result finished a close 6th, beaten a nose and a head for 4th.

Mr Pinn agreed with the Stipendiary Steward’s interpretation and said that it was due to a lack of concentration and that he will learn from his mistake.

Mr Harris said that Mr Pinn has had limited race rides and is still learning. He added that the heavy ground did not help the situation.

Submissions for Penalty:

Mr Balcombe said it was Mr Pinn’s first charge of any kind under the Rules of Racing and submitted that the Committee consider a term of suspension.

Mr Pinn and Mr Harris did not make any comment regarding penalty.

Reasons for Penalty:

The film replays showed very clearly that ARABICA was in 4th position when Mr Pinn stopped riding out and as a consequence was only just beaten for 4th and 5th position. The Committee took into account the following matters when considering quantum of penalty:
• The admission of the breach
• Limited race-riding experience
• First breach of the Rule
• That if Mr Pinn had continued to ride out, it was reasonable to expect that his mount ARABICA would have finished 4th
• That horses shorten stride quickly in heavy ground when riders cease to ride-out and sit up
• The JCA starting point of 2 weeks suspension for such a breach
