We are satisfied ALWAYS TREASURE has failed to promptly regain its gait and we exercise our discretion and disqualify the horse pursuant to r 1003(2).

Amended placings are:

1st 1 SALUTE THE MONARCH
2nd 6 ROYAL SQUEEZE
3rd 8 PRISCILLA P
4th 2 SHUTTERUP
5th 5 KRYSTAL GAZER

Dividends and stakes are to be paid accordingly.

Facts:

This was a protest by Mr Wallis against horse number 4, ALWAYS TREASURE, which was placed 4th by the Judge on the ground that the horse breached the provisions of r 870(3) and the breaking horse regulations, in that ALWAYS TREASURE broke in excess of 150 metres in the early stages.

Mr Wallis had Mr Ydgren, stipendiary steward, demonstrate on the videos that ALWAYS TREASURE broke shortly after the start and continued in a gallop for approximately 165 metres before regaining its trotting gait.

Mr Middleton the trainer/driver of ALWAYS TREASURE, indicated that he represented the connections and, after viewing the videos, he accepted that the distance was in excess of 150 metres.

Reasons for Decision:

The breaking horse regulations provide that a horse that gallops in excess of 150 metres at the start or during the running of a race is deemed to be in breach of r 870(3) in that it has failed to promptly regain its proper gait.

We have viewed the incident on the videos and we are satisfied that ALWAYS TREASURE broke for a distance in excess of 160 metres shortly after the start.
