Facts:
Prior to the running of race 1, an Information was filed pursuant to Rule 330 (3) (c). The Informant, Mr Coles, alleged that Mr Harris failed to make the weight for NAVAL BRIGADE and O’ HE CAN.
Mr Harris said that he understood the Rule and confirmed he admitted the breach.
Rule 330(3)(c) provides: “A rider shall not fail to ride a horse at the weight at which it is handicapped to carry”.
Mr Coles advised that Mr Harris failed to make the handicapped weight of 58.5 kgs on NAVAL BRIGADE in race 1 and O’HE CAN in race 6. He said that Mr Harris was really struggling with his weight.
Mr Harris said that he has been on a diet and was trying to do his best. He added that he was considering taking a break to try and get his weight under control.
In response to a question from the Committee, Mr Coles advised that Mr Harris was 1 kg over the handicapped weight.

Mr Coles said that today was Mr Harris’ 3rd breach of this Rule within the last 120 days.

23 September - $200 fine
Mr Coles said that a monetary penalty would be appropriate and a fine the vicinity of $300 to $400 should be imposed.
Mr Harris acknowledged that an uplift from his previous penalties would be applied.

The Committee carefully considered all the evidence and submissions presented.
The Committee notes that this is Mr Harris’ 3rd breach within the last month. This confirms that Mr Harris is struggling to get his weight under control. However, the onus is on Mr Harris to manage his weight so he does not let down the Owners, Trainers and the betting public who have supported him.
The only mitigating fact was Mr Harris’ admission of the breach.
After taking into account all of the above the Committee deemed that an appropriate penalty was a $350 fine.
