Facts:

At the conclusion of Race 10 the Earl Drake Builder Mobile Pace, an Information was lodged by Stipendiary Steward Mr V Munro alleging that Open Driver Mr W Low struck the wheel of Lynryd Skynryd ( K Tomlinson) whilst attempting to improve passing the 600 metres.

Mr Low admitted the charge and confirmed he understood the Rule and was present at the hearing.

Miss Hayley (Stipendiary Steward) used several video clips to highlight the incident showing Taxman (W Low) moving forward and striking the wheel of Lynryd Skynryd.

Mr Low agreed with Miss Hayley’s summation of the incident.

Submissions for Penalty:

Mr Munro stated that Mr Low has had 583 lifetime drives as an Open Driver, nil last season and two this season.

Mr Munro said the breach was low to mid-range of carelessness, the aggravating fact that Mr Low's horse Taxman has had its chances extinguished. Mr Munro stated the JCA Penalty Guide recommended a six-drive suspension or a fine of $300.

Mr Munro also stated that in his opinion a suspension was not appropriate in this instance, due to Mr Low having very few drives over the last two or three seasons.

Mr Low said he would prefer a suspension but acknowledged Mr Munro’s preference, referring to his limited driving opportunities.

Reasons for Penalty:

After considering the submissions, the Committee agreed with Mr Munro's point, that a suspension was not appropriate in this instance.

Mr Low was given credit for his admittance of the breach.
