As Miss Johnston admitted the breach it was found to be proved.
Penalty:
Miss Johnston’s Jockey’s Licence was suspended for 3 riding days, commencing at the end of racing on 16 December 2012 up to and including racing on 22 December 2012. The three days being Matamata (19 December), Otaki (20 December) and Manawatu/Te Rapa (22 December 2012).
Charge:
Following the running of Race 8 an information was filed by Mr N Goodwin under Rule 638(1)(d). The information stated that Miss V Johnston (Quality Street) shifted in when not clear of Little Drummer Boy (K Myers) which was checked (near 100m).
Miss Johnston acknowledged that she understood the rule and the charge.
Facts:
Mr Goodwin showed all the available films and said that near the 100m Little Drummer Boy was racing a little back and to the outside of Quality Street (V Johnston) and that Little Drummer Boy shifted to the inside of Quality Street for a run, had improved up on the inside and that Quality Street then shifted in towards the running rail, forcing Miss Myers to steady and shift to the outside of Miss Johnston’s mount.
Miss Johnston, for her part, said that she was not aware that anything untoward had happened until she was shown the film and said that there was not any calling. Miss Johnston conceded that her mount was about one length clear when shifting in across the line of Little Drummer Boy.
Submissions for Penalty:
Mr Goodwin said that Miss Johnston had a very good record, that the carelessness was mid to low-range and submitted that a suspension was an appropriate penalty.
Miss Johnston said that her last suspension was approximately 12 months ago and that if a suspension was to be imposed that it commence after racing on 16 December 2012. She added that she did not intend riding in the South Island in the near future.
Reasons for Penalty:
The committee deemed that the carelessness was in the low-range. It took into account Miss Johnston’s unblemished riding record during the past 12 months, the starting point of 5 riding days and Miss Johnston’s frankness during the hearing. The committee believed a suspension of 3 riding days was the appropriate penalty.
