Mr Lilley admitted the breach, which we thus find proved.
Penalty:
Having regard to Mr Lilley’s excellent record and admission of the breach, he is suspended from driving from the end of racing on 8 December 2010 up to and including 16 December 2010. This is 3 days.
Charge:
Mr Lilley is charged with a breach of R 869(4) and (6)(b) and (c) (the push out rule) in that he forced READY SET (N McGrath) to race wider on the track near the 2000 metres. Mr Lilley admitted the breach, which we thus find proved.
Facts:
Mr Renault demonstrated that Mr Lilley looked before moving out but unfortunately Mr McGrath was progressing faster than he had anticipated and the nose of his horse was clearly up beyond Mr Lilley’s cart when Mr Lilley came out. The result was Mr McGrath raced 4 wide for about 100 metres.
Mr Lilley said it had not affected Mr McGrath’s chances as Mr McGrath had gone on to win the race.

Mr Renault produced Mr Lilley’s record under this rule, which was clear. He submitted that a 3 day suspension was appropriate as Mr Lilley had only few drives at any meeting.
Mr Lilley said he believed this submission was fair.
Reasons for Penalty:
We are aware that a usual penalty for an admitted breach of the push out rule is a $200 fine. Mr Lilley usually has one drive on a raceday. A three-day suspension is thus equivalent to a fine of this magnitude.
